General Terms And Conditions

All orders on the Site are subject to these general terms and conditions of sale. These are subject to modification and update, the conditions applicable to the order of a product by a customer are those in force on the day of the order. These general terms and conditions of sale are subject to French law.

These general terms and conditions of sale (hereinafter the "General Terms and Conditions of Sale") exclusively govern sales made on the website Ibisoul.online (hereinafter the "Site") of the products offered by Ibisoul to buyers who are consumers (hereinafter the "Customer(s)) and specify the conditions of ordering, payment, delivery and management of any returns of products ordered by Customers.

The General Terms and Conditions of Sale are enforceable against the Client who declares that he has read them and has accepted them by ticking the box "I accept the General Terms and Conditions of Sale" before implementing the online ordering procedure.

The customer of the Site must be a consumer, a natural person of legal age and legal capacity. The customer must, when placing his first order on the Site, open a customer account and fill in an order form specifying certain mandatory fields so that his order of products can be taken into account by Ibisoul.

The information communicated to Ibisoul when opening a customer account or at the time of each of its orders must be complete, accurate and up-to-date. 

In view of the commercial policy described above, Ibisoul reserves the right not to process orders from subjects that differ from the "Consumer" or orders that do not comply with its commercial policy.

On Ibisoul.online are exclusively sold carefully selected top quality products 

The essential characteristics of the products are presented on Ibisoul.online inside each of the product sheets. However, the images and colors of the products offered for sale on Ibisoul.online may not correspond to the actual colors due to the effect of the Internet browser and the screen used, as well as the artisanal side of the manufacture of the necklaces and the cutting of the stones.

The taking of orders on the Site is subject to compliance with the procedure set up by Ibisoul, concretized by a succession of different screen pages indicating the steps that the customer must imperatively follow to validate his order. The customer will have the possibility, before definitively validating his order, to check the details of the order and its total price, and to correct any errors, before confirming it to express his acceptance.

Ibisoul will also have the right to refuse any order placed by a customer with whom there is a dispute relating to the payment of a previous order as well as any order that does not comply with these general terms and conditions of sale. In these cases, Ibisoul will inform the customer by telephone or email. If the customer fails to correct the erroneous elements or elements contrary to these general terms and conditions of sale, Ibisoul reserves the right not to process the order.

To conclude the contract for the purchase of one or more products on Ibisoul.online, you must complete the order form offered by the site by following the relevant instructions. 

The order form contains a summary of the General Terms and Conditions of Sale, as well as information on the essential characteristics of each of the products ordered and the price that refers to them (including applicable taxes or duties), the means of payment that you can use to purchase each product and the terms of delivery of the products purchased,  the costs of shipping and delivery, the conditions for exercising your right of return, and finally, the terms and deadlines for returning the products purchased.

The contract is concluded when Ibisoul receives your order form electronically and once the accuracy of the order data has been verified.

Before proceeding with the purchase of the products by submitting the order form, you will be asked to carefully read the General Terms and Conditions of Sale. The order form will be archived in our database for the time necessary for the shipment of the orders and according to the legal deadlines. You will be able to access your order form by consulting the "My Account / My Orders" section. Before proceeding with the transmission of the order form, you will also be asked to detect and correct any data entry errors. The languages available to conclude the contract with Ibisoul are French, English and Spanish.

Once the contract has been concluded, Ibisoul will take care of your order.

In the event that the products presented on Ibisoul.online are no longer available or for sale at the time of your last access to the site or the sending of the order form, Ibisoul must promptly inform you, and in any case, within thirty working days from the day following your order, of the possible unavailability of the products ordered. In the event of the transfer of the order form and payment of the price, Ibisoul will take the necessary steps to reimburse the amount you have advanced.

By electronically transmitting the order form, you accept the General Terms and Conditions of Sale and you undertake to comply with these conditions in your dealings with Ibisoul. If you do not agree with any of the terms and conditions set out in the General Terms and Conditions of Sale, we invite you not to transfer your order form for the purchase of products to Ibisoul.online and to contact us by email.

 

Orders are not subject to change due to immediate execution and for technical reasons. In the event of a malfunction of the site that has affected orders or transactions, or a shortage of stock concerning the products ordered, Ibisoul will have the possibility to cancel online orders placed by customers. He will inform the customer by email or phone to indicate the reason for the cancellation of the orders placed.

The prices displayed on the website are indicated in Euros.

When you first connect to the Ibisoul eshop, the site, depending on your IP address, sends you directly to the corresponding zone (if your IP address is American, the site offers you the prices in American dollars of the USA zone).

For all countries with a delivery address in France and in countries belonging to the European Union the products will be invoiced in Euros. The prices displayed on the E-shop are inclusive of all taxes (including VAT), excluding delivery costs. The prices invoiced to the customer are those in force on the date of the order.

For customers residing outside the territory of the European Union and in the French Overseas Departments and Territories, it is specified that the prices displayed on the Site will be invoiced excluding customs taxes 

Payment is made by credit card or PayPal.

For credit card payments, the customer must be the holder of the credit card used. They have access to a dedicated space provided by a banking institution, which ensures the security and registration of the payment order.

The customer is informed that, in order to combat fraud on the internet, a check will be carried out with the competent banking institutions and organizations, queried via the 3D Secure system.

During the transaction, the cardholder is directed to a page of their bank and enters data that the bank can verify.

In the event that, for any reason whatsoever (opposition, refusal by the issuing centre, etc.), it is impossible to debit the sums due by the customer, the order will not be registered by Ibisoul.

The customer is solely responsible for a failure of delivery due to a lack of indication when placing the order. The customer can choose from the following 3 delivery methods:

  • Tracked Letter (less than 2kg)

  • Collissimo

  • Chronopost

The parcel is delivered according to the shipping method chosen by the Client and is delivered to the recipient against signature of a delivery note (depending on the delivery method), to the delivery address indicated during the ordering process.

It is the Customer's responsibility to ensure the external appearance of the packaging and to note on the delivery note any visible damage to the packaging.

Ibisoul undertakes to ship all orders placed within 24 hours of the order being placed (only on working days).

However, during busy periods such as Christmas, Ibisoul reserves the right to extend the shipping time to 72 hours.

It is specified that any change of delivery address made by the Client after the order has been registered may result in an extension of the delivery time.

Article L.221-15 of the French Consumer Code: "The trader is automatically liable to the consumer for the proper performance of the obligations resulting from the contract concluded at a distance, whether these obligations are performed by the professional who concluded this contract or by other service providers, without prejudice to his right of recourse against them. However, he may exonerate himself from all or part of his liability by providing proof that the non-performance or poor performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable act of a third party of the contract, or in the event of force majeure. »

The customer has a right of withdrawal which he can exercise, without having to justify reasons, within fourteen (14) clear days from the day after receipt of the products ordered.

The customer thus has the possibility to copy, complete and send by email this withdrawal form if he wishes to withdraw from the contract as provided for by Article L.221-5 of the Consumer Code.

When the period of fourteen (14) clear days from the day after receipt of the ordered products expires on a Saturday, Sunday or a public holiday or non-working day, it shall be extended until the next working day.

To simplify the exercise of the right of withdrawal, Ibisoul asks customers to notify it by any means. On this occasion, the customer will be able to specify whether he wishes a refund or a credit note.

The products must be returned in perfect condition, complete (accessories, instructions, warranty, etc.) accompanied by the invoice and a word of explanation recalling the customer's contact details as well as his desire to receive a refund or a credit note, to the following address:

Any customs fees related to the return of a product from a foreign country are also the responsibility of the customer.

When requesting a return from My Account, My Orders, you have the option of requesting:

Either a credit note valid only on the Ibisoul.online website, or a refund, the return costs are then at your expense.

Ibisoul strongly advises its customers to return products by tracked letter. The customer has the option to choose the carrier of their choice. If the return costs are borne by the customer (in the case of a refund request) then the risks associated with them are borne by the customer. It is therefore recommended that the company provide proof of this return, which presupposes that the products are returned with parcel tracking, or by any other means giving a certain date.

The right of withdrawal – in addition to compliance with the deadlines and procedures described in the previous points – is considered to be correctly applied in the event that the following conditions are fully complied with:

  1. - We invite you to notify us by email, phone, post or via your account of your return request.

  2. -The product must not have been worn, worn, altered, washed or damaged.

  3. -The label attached to the jewel must not be removed otherwise the refund cannot be made.

  4. - In the case of an order for several goods delivered separately or in the case of an order for a product consisting of multiple lots or pieces whose delivery is spread over a defined period, the refund period (within 14 days from the request for the exercise of the right to withdraw from reimbursement),  The period runs from the date of receipt of the last item or lot.

  5. -The product must be returned in its original packaging 

  6. Ibisoul will only refund you the sums collected for the purchase of the products, the shipping costs for the delivery of the purchased products will be deducted from the refund.

In the event that the terms and conditions for exercising the right of withdrawal have not been complied with, as above, you will not be entitled to a refund of the sums already paid to Ibisoul. You may, however, obtain, at your own expense, your products, in the condition in which they were returned to Ibisoul. Otherwise, Ibisoul may retain the products, in addition to the sums already paid for their acquisition.

If the right of withdrawal is exercised in accordance with the terms and conditions indicated above, Ibisoul will take the necessary steps to reimburse any sums already collected for the purchase of the products within fourteen (14) clear days from the day following receipt and verification of the condition of the products.

In the event that there is no correspondence between the recipient of the products indicated in the order form and the one who made the payment of the sums due for the purchase, the refund of the sum, in the event of exercising the right of withdrawal, will be made by Ibisoul, in any case, to the one who made the payment.

The refund will be made on the same medium as the one used when purchasing the products, either the credit card or the customer's PayPal account.

Regardless of any commercial warranty that may be granted by Ibisoul to the Client, all products supplied by Ibisoul benefit from the legal guarantee of conformity provided for in Articles L. 217-3 to L. 217-17 of the Consumer Code and the legal guarantee against hidden defects provided for in Articles 1641 to 1648 of the Civil Code.

As part of these guarantees, Ibisoul undertakes, at the Customer's choice, to reimburse or exchange defective products or products that do not correspond to their order.

To benefit from the warranty, the Client must contact Ibisoul's Customer Service by following these steps:

1. Have the order number and reference number of the item concerned (this information is indicated on your purchase invoice);

2. Send the request for support to Ibisoul's Customer Service by email at the following address: contact@ibisoul.online

In order to ensure a fast and high-quality processing of the warranty claim, the Customer will specify his contact details, his order number and the reference of the item concerned and will detail as much as possible the problem encountered and, as far as possible, will attach to the email a photograph of the product defect.

The consumer has a period of two years from the date of delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its occurrence.

The legal guarantee of conformity gives the consumer the right to repair or replace the goods within thirty days of their request, free of charge and without major inconvenience for them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original warranty.

If the consumer requests the repair of the goods, but the seller insists on the replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund against return of the goods, if:

1° The professional refuses to repair or replace the property;

2° The repair or replacement of the property takes place after a period of thirty days;

3° The repair or replacement of the goods causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-conforming goods, or if they bear the costs of installing the repaired or replacement goods;

4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into compliance.

The consumer is also entitled to a reduction in the price of the good or to the rescission of the contract when the lack of conformity is so serious that it justifies the reduction of the price or the rescission of the contract being immediate. In this case, the consumer is not required to request the repair or replacement of the goods beforehand.

The consumer is not entitled to the cancellation of the sale if the lack of conformity is minor.

Any period of immobilization of the property for the purpose of its repair or replacement suspends the warranty that remained until the delivery of the repaired property.

The above-mentioned rights result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.

A seller who obstructs the implementation of the legal guarantee of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles you to a price reduction if the property is retained.

The Client acknowledges that the Ibisoul Products and the distinctive signs (image, photographs, packaging, name of the products, etc.) are the exclusive property of Ibisoul.

The Client shall refrain from any act of reproduction or use of the product models, packaging, trademarks or distinctive signs, inventions, techniques or know-how used by Ibisoul, as well as any act tending to the appropriation of these elements, whether or not they are protected by Ibisoul by a patent, trademark, registered design and model or copyright.

The Client is informed that the data he provides on the Website is subject to various automated processing of personal data.

In application of the law n°78-17 of 6 January 1978 relating to data processing, files and freedoms, it is reminded that the personal data collected from the Client is necessary for the processing of his order. It can also be used for prospecting purposes. The purposes of each processing are described in relation to the processing concerned.

This data is intended for internal use by Ibisoul. This personal data may also be transmitted to third parties, partners of Ibisoul, unless the Client has objected to this when collecting the data concerning him/her.

The Client's personal data is kept for the period strictly necessary to achieve the purposes for each of the processing operations envisaged by Ibisoul.

Ibisoul cannot be held liable in the event of non-performance or poor performance of the contract due either to the Client, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.

Sales made to Ibisoul via the www.Ibisoul.online website are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing this, all disputes to which this contract may give rise, concerning its validity, interpretation, execution, termination, consequences and consequences shall be submitted to the competent court in accordance with the rules of jurisdiction of the common law.
